Special E-shop Terms & Conditions

1. Right to use e-shop services
1.1. To shop at this e-shop can:
1.1.1. persons of full age whose insanity is not limited to a court order;
1.1.2. minor from fourteen to eighteen years of age, only by having parents or guardians, except when they dispose of their income;
1.1.3. juridical persons;

2. Second exchange information
2.1. Seller sends all the messages to the e-mail provided at the Buyer registration form.
2.2. Buyer sends all the messages and questions through the communication tools provided at the Seller e-shop section “Contacts”

3. Purchase-sale agreement contract moment
3.1. The agreement between the buyer and the seller is considered concluded from the moment the buyer selecting goods and filling in all the “Checkout” section fields, clicks “Place order”. 
3.2. Each sale – purchase agreement made between the buyer and the seller is registered and stored in this e-shop database.

4. Customer’s rights
4.1. The buyer has the right to purchase goods in e-shop by the conditions stated here.
4.2. The buyer has the right to refuse the sale – purchase agreement concluded with the UAB “Balt Partner Group”, notifying the seller in writing (e-mail, indicating the product being returned and its order number) no later than 7 (seven) business days after delivery of the item.
4.3. Paragraph 4.2 of the rules provides the buyer the right to be implemented in accordance with the Minister of Economy in 2001. August 17. Order No. 258 approved the sale of items and services when the contracts are awarded by means of communication rules.
4.4. According to paragraph 4.2 of the rules the right buyer can use only exists if the item meets all return terms & conditions specified in paragraph 10. 

5. Customer’s obligations
5.1. The buyer must pay for the goods and accept it according to these rules.
5.2. The buyer undertakes not to transfer his/hers login information to third parties. If the buyer loses login information, he/she must immediately inform the seller in writing.
5.3. If data in the buyer registration form changes, it must be immediately updated by the buyer.
5.4. While using this e-shop the buyer is committed to comply with these rules, and other conditions clearly specified in e-shop as well as not to intact Lithuanian legislations.

6. Seller’s rights
6.1. If the buyer is trying to undermine this e-shop work stability and security, or infringe its obligations, the seller has the right to immediately and without notice to suspend or restrict access to the e-shop, or in exceptional cases, eliminate the buyer’s account.
6.2. In case of serious circumstances, the seller may suspend or terminate the e-shop operations with prior notification to the buyer.

7. Seller’s obligations
7.1. Seller agrees to these rules and conditions required in e-shop to let the buyer to use this e-shop services.
7.2. Seller agrees to respect the privacy of the buyer, the right to his personal information, provided at the e-shop on the registration form, with the exception of the Republic of Lithuania laws and rules on the protection of personal data for the cases.
7.3. Seller agrees to deliver the goods ordered to the address indicated in paragraph 9 of the specified conditions.
7.4. If the buyer is not able to deliver the ordered goods for valid reasons, he undertakes to offer a similar item. If the buyer refuses to take a similar item, the seller agrees to refund the money paid by the buyer within 10 (ten) business days, if the ​​payment in advance was made.
8. Product prices, payment procedures and deadlines 
8.1. Commodity prices in e-shop and in the formed order are in Euros VAT inclusive. Shipping fees are applicable.
8.2. The buyer pays for the goods in one of the following ways:

8.2.1. Payment by credit card.
8.2.2. Payment by PayPal system.
8.2.3. Payment by Paysera system. 

8.3. Milky Aisle e-shop uses Secure Sockets Layer (SSL) encryption where the buyer’s payment details are collected. This protects the confidentiality of the buyer’s credit card information while it’s transmitted over the Internet. 

9. Delivery
9.1. When ordering goods the buyer undertakes the responsibility to indicate the delivery address.
9.2. The buyer undertakes to accept the goods by himself. In the case that he himself can not accept and the goods delivered to the address given on the other basis of data provided by the buyer, the buyer has no right to make claims against the seller for delivery ill.
9.3. The seller undertakes the responsibility to deliver the goods to the address indicated by the buyer. This does not apply in cases where the seller does not stock the necessary items, and the buyer was informed about the lack of it. Along buyer agrees that in exceptional cases, delivery may be delayed due to unexpected circumstances beyond the seller. In this case, the seller agrees to immediately contact the buyer and coordinate such delivery issues.
9.4. In all cases, the seller is released from liability for breach of terms of delivery if the buyer of the goods are not delivered or not delivered on time due to the fault of the buyer or the buyer within the circumstances.
9.5. All Milky Aisle orders are shipped via TNT. The seller aims to have the order delivered within 3 – 7 business days from the time the buyer places his order for all European addresses and 7 – 14 business days for all international addresses. 
9.6. The shipping fees are:
– Ground shipping (Lithuania) EUR 7;
– Economy Express Europe EUR 20;
– Economy Express International EUR 40. 
9.7. The buyer shall note that the seller is not able to deliver to PO Boxes or Freights forwarders. 
9.8. Once the buyer had placed the order, the seller is unable to amend the delivery address indicated by the buyer. 
9.9. At the delivery time buyer must to check the condition of the particular product. Noticing that the package of the goods delivered is damaged (torn or otherwise damaged externally), the buyer may not be obliged to accept the goods. If the buyer fails to make these steps, the seller is relieved of liability to the buyer for goods damage, if such damages are the result of the damaged packaging which buyer did not notice at the time of delivery. 

10. Taxes and Duties for orders outside EU
Once the order arrives at its destination outside EU the buyer will be required to pay all import duties, customs and local sales taxes levied by the non-EU country the buyer is shipping to, in order to release the order from customs.

11. Returns and exchanges
11.1. The buyer has 7 (seven) calendar days from receipt of the order to inform in writing the seller of his intention to return or exchange. The buyer then has a further 7 (seven) calendar days to return the goods back to the seller. Returns outside this period will not be accepted. 
11.2. All Milky Aisle items need to be returned in an unmarked, unused condition with the original packaging including labels and the branded shoe box which is considered as part of the product and should be returned in a protective shipping box.
11.3. Due to the delicate nature of Milky Aisle items (shoe soles, insoles, outer fabric and embellishments), shoes must be tried on a clean dry protected surface (e.g. a carpeted surface, cloth of delicate fabric) and away from any moisture and dirt. Shoes that are returned without a box, in a damaged box, with market soles, damaged, scratched or dirty outer fabrics and insoles, damaged or missing embellishments or missing other components such as labels will not be accepted, and will be sent back to the delivery address used in the original order (this does not apply to the case of a defective item is returned). 
11.4. Any items that have been altered or repaired by an external repair service will not be accepted for a refund or exchange. 
11.5. When returning the item it is necessary to include acquisition document – the invoice and a filled in and signed return form, which can be downloaded here.
1.6. The buyer is required to use the seller’s TNT account No. 000114730 to return any items back. The seller is not liable for any good that are not returned in this way. 
11.7. The buyer is required to return item(s) from the same address to which they were delivered. 
11.8. The seller aims to process all returns within 48 hours of receiving the order back. 
11.9. All returns are thoroughly inspected in accordance with rules stated above. Once accepted, the buyer will receive and e-mail confirmation of his return and refund or exchange. 
11.10. All items returned in accordance with our rules will be credited to the original buyer’s account including sales taxes (within Europe), but excluding delivery charges for shipments and returns. International customs duties and sales taxes are non-refundable for international shipments outside Europe. Exchanges are free of delivery charge.
11.11. The refunds may take up to 10 (ten) business days to appear on the buyer’s account depending the bank/credit card issuer/payment system used. 
11.12. All exchanges for a more suitable size are subject to stock availability.
11.13. Any items purchased can be arranged for an exchange of size only once.
11.14. The seller is unable to exchange any item for an alternative color or style, therefore the buyer is suggested to return his purchase for a refund and place a new order for the preferred item. 
11.15. Returns and exchanges carried out in accordance with the Minister in 2001 June 29. Order No. 217 approved return and exchange rules and Minister of Economy in 2001. August 17. Order No. 258 approved the sale of items and services when the contracts are awarded by means of communication rules.

12. Defective items
12.1. An item is deemed defective if it has been received by the buyer in an imperfect condition or if there is a manufacturing fault or design error.
12.2. The seller does not consider wear and other damage specified in clause 10 to be a defect. 
12.3. To return a defective item the buyer shall contact the seller and provide him with the following information: proof of purchase (invoice, order number), a short description of the defect, supporting images. Following that, the buyer’s customer service team will be in touch with the buyer shortly to advise the next steps for arranging the return or replacement. 

13. Responsibility
13.1. The buyer is fully responsible for his account registration form and the correctness of the data. If the buyer fails to form accurate account registration data, the seller is not liable for the resulting consequences.
13.2. The buyer is responsible for the actions carried out by using this e-shop.
13.3. The buyer is responsible for giving their login information to any third parties. If this e-shop services are used by the third person connected to an e-shop using the buyer’s login information, seller takes this person as a buyer.
13.4. The Seller is exempt from any liability in case of loss stems from the fact that the buyer, regardless of the recommendations and their own commitment did not get familiar with these rules, although this option was granted.
13.5. If seller’s e-shop contains links to other companies, organizations or individuals websites seller is not responsible for the information contained therein or activities, the Web does not monitor, control, and those companies and individuals represented.
13.6. In case of damage, the guilty party shall indemnify the other party for direct losses.

14. Marketing tools applied by the seller
14.1. Seller may to initiate various e-shop campaigns at its discretion.
14.2. Seller has the right, without prior notice, change the terms of the sales, as well as remove them.

15. Final Provisions
15.1. These rules are made in accordance with the legislation of the Republic of Lithuania.
15.2. These rules apply to the relationship arising from the Ministry of Law.
15.3. All disputes arising in respect of the implementation of these rules are resolved by negotiation. Failing an agreement it is settled in accordance with the laws of the Republic of Lithuania.
